Parents Seek Millions in Malpractice Lawsuit

On August 19, 2015, a malpractice lawsuit was filed with the United States District Court in the District of Puerto Rico against the hospital and the doctors who delivered and cared for a Texas, baby boy. The parents of the baby claim the medical staff breached numerous standards of care that caused permanent brain damage to their child. Hospital Buen Samaritano, Hospital de la Concepcion, Dr. Mabel M. Bonilla, Dr. Laura S. Puig Marrero, and Dr. Miguel Saurez Villamil were named as the defendants in the malpractice lawsuit.

The plaintiff mother was admitted to Hospital Buen Samartiano on September 27, 2015, after visiting her obstetrician, defendant Dr. Mabel Bonilla after complaining of pelvic pressure. Exams showed that the mother’s cervix was ready to give birth although she was not having contractions, and her water had not broke. Labor was induced at Samartiano, and the baby was born that day in critical condition and required specialized care. According to the plaintiff, there are also discrepancies between the hospital’s records and the actual treatment and care she and her baby received. The mother further alleges that notes on the medical records have been altered.

The plaintiff further recalls that there were many complications with the baby’s birth including indications of shoulder dystocia. The mother notes that she delivered the baby’s body, but his head did not follow. After many attempts by doctors to deliver the baby, he was finally delivered unresponsive and colorless. Shortly after birth, the baby was placed on a mechanical ventilator and treated for perinatal asphyxia then transferred to Hospital La Concepcion where he was diagnosed with respiratory failure, clinical sepsis, and perinatal asphyxia.

Additionally the baby, suffered seizures the day after birth and remained in the hospital for nearly a month. He was later diagnosed with multicystic leukoencephalopathy after it was determined that the white matter of his brain contained many cysts. Current ongoing medical issues of the baby include physical, motor, and developmental delays, seizures, visual impairment and hearing loss. The plaintiff’s claim that both the hospital and doctors failed to monitor and respond properly to their child’s birth. They are seeking $27 million dollars in compensation for their child’s pain and suffering as well as their own.
