PARENTS SEEK MILLIONS IN MALPRACTICE LAWSUIT

On August 19, 2015, a malpractice lawsuit was filed with the United States District Court in the District of Puerto Rico against the hospital and the doctors who delivered and cared for a Texas, baby boy. The parents of the baby claim the medical staff breached numerous standards of care that caused permanent brain damage to their child. Hospital Buen Samaritano, Hospital de la Concepcion, Dr. Mabel M. Bonilla, Dr. Laura S. Puig Marrero, and Dr. Miguel Saurez Villamil were named as the defendants in the malpractice lawsuit.

Hospital Buen Samartiano

 

Defendant Dr. Mabel Bonilla admitted the plaintiff mother to Hospital Buen Samaritano on September 27, 2015, after the plaintiff mother complained of pelvic pressure during her visit to her obstetrician. Exams showed that the mother’s cervix was ready to give birth although she was not having contractions, and her water had not broke. The medical team at Samartiano induced labor, and the baby was born that day in critical condition, requiring specialized care. The plaintiff alleges that the hospital’s records do not match the actual treatment and care she and her baby received. The mother further alleges that someone has altered the notes on the medical records.

The plaintiff further recalls that there were many complications with the baby’s birth including indications of shoulder dystocia. The mother notes that she delivered the baby’s body, but his head did not follow. Doctors made many attempts to deliver the baby, and they finally delivered him unresponsive and colorless. Shortly after birth, they placed the baby on a mechanical ventilator and treated him for perinatal asphyxia, then transferred him to Hospital La Concepcion, where they diagnosed him with respiratory failure, clinical sepsis, and perinatal asphyxia.

 

Additionally the baby, suffered seizures the day after birth and remained in the hospital for nearly a month. Later, doctors diagnosed him with multicystic leukoencephalopathy after they determined that many cysts were present in the white matter of his brain. Current ongoing medical issues of the baby include physical, motor, and developmental delays, seizures, visual impairment and hearing loss. The plaintiff’s claim that both the hospital and doctors failed to monitor and respond properly to their child’s birth. They are seeking $27 million dollars in compensation for their child’s pain and suffering as well as their own.
